Advisory and title services

Everything in Levels 1 to 4 is a service somebody will pay for on its own. It is also the arm with the sharpest professional boundary.

What it is

Selling the work of Levels 1 to 4 directly, as a service, rather than as an input to a transaction you are brokering. Record retrieval and interpretation, chain assembly, map work, comparables and site assessment — delivered as a report the client pays for whether or not a transaction follows.

The demand is real. A great many people about to spend a substantial sum on land have no way to assess it and no relationship with anyone who does. What they usually do instead is rely on the seller's broker, which is not diligence.

The professional boundary — read this before anything else. Title investigation and legal opinion are the work of a licensed advocate. Preparing and advising on legal documents is legal practice. You may retrieve records, organise them, explain what a document says as a matter of fact, assemble a chain, identify gaps and prepare a file. You may not give a legal opinion on title, advise on the legal effect of documents, or hold yourself out as providing legal services. Every one of these is factual work. None of them requires you to express an opinion on whether title is good.

Who buys it

  • First-time buyers spending a large proportion of their savings.
  • Landowners preparing to sell, who want their file complete before a buyer's advocate starts finding problems.
  • Lenders and institutions requiring documented assessment.
  • Other agents without the capability, who would rather subcontract than learn it.

How it is priced

As a fee for defined work, not as a percentage of value and not contingent on the transaction proceeding. That independence is the point of the service — a report the client pays for regardless is worth more than one produced by someone who is paid only if the deal completes.

The fee should reflect the actual work, which varies enormously: a sole-holder parcel with a clean recent chain is a morning; a nine-heir unmutated holding with a partition dispute is weeks. Scope the engagement before quoting, and price disbursements — record fees, travel, authority charges — separately and transparently. We publish no rates.

The professional risks

  • Straying into legal advice. The most serious risk and the easiest to drift into, because clients will ask directly and repeatedly. The answer is a referral, not an opinion.
  • Being relied on for what you did not check. Define the scope of the report in writing and state plainly what is outside it.
  • Report used for a purpose it was not prepared for. State the purpose and the date. Records go stale.
  • Errors in retrieval. A wrong khasra number propagates into everything. Level 2, Lesson 2.
  • Conflict. Preparing a report for a buyer on a parcel you are also brokering for the seller is a conflict that must be disclosed and, in most cases, avoided.

Who it suits

Someone genuinely good at records who prefers structured work to selling. It requires no capital, produces fee income independent of transactions, and pairs naturally with brokerage — though the conflict point above must be handled honestly. It also builds exactly the reputation that generates brokerage instructions.

First ninety days

  1. Days 1–15. Write your report template. Sections, scope statement, exclusions, purpose and date. Have an advocate review the wording of the scope and exclusions.
  2. Days 16–40. Produce three complete reports on real parcels, unpaid, and have an advocate critique each one.
  3. Days 41–60. Time yourself. Establish what a straightforward parcel costs you in hours, and what a complicated one costs.
  4. Days 61–75. Agree a referral relationship with an advocate, so that when a client needs an opinion there is somewhere to send them immediately.
  5. Days 76–90. Take your first paying client and deliver to the template exactly.
