Definition
A provision treating an application as provisionally approved if no order issues within a set period.
Deemed approval (डीम्ड या मान्य स्वीकृति) is a rule written into some approval processes: if the authority does not decide an application within the period the rule sets, the application is treated as approved — provisionally or finally, as that rule says. It protects an applicant from open-ended delay. It usually runs only from a complete application, and only where the specific rule provides for it.
Examples differ by state. Karnataka is the most cited case of deemed provisional approval for land conversion. In Rajasthan’s rural conversion rules, an application for a tourism unit that is not disposed of within 45 days is deemed converted (Rule 9(8)) — see rural land conversion in Rajasthan. Before relying on a deemed approval, keep proof of the date you applied and confirm the position with the authority in writing.
