The short version

Two neighbours sell farmland in the same week for the same money. One pays no capital gains tax. The other has a substantial bill. The land is not different in any way you could see standing in it — the difference is where a municipal boundary happens to run.

Capital gains tax applies to the transfer of a capital asset. The Income-tax Act specifically excludes certain agricultural land in India from the definition of capital asset. Where land falls in that excluded category, there is no capital gain to tax — not an exemption you claim, but a transaction that never enters the charge.

Where the land does not fall in that category, it is a capital asset like any other, and the usual machinery applies.

Two conditions do most of the work. First, the land must actually be agricultural land — used for agriculture, not merely recorded that way while lying as a plot awaiting development. Second, it must sit outside specified distances from a municipality or cantonment, where the distance depends on the population of that municipality.

Why this matters near a growing city. Land on the fringe of an expanding municipality can move from one side of the test to the other as boundaries and population figures change. Land you bought as rural may not be rural when you sell. This is precisely the kind of detail a chartered accountant should confirm on your facts.

If the land is agricultural but falls within the specified distance of a qualifying municipality, it is a capital asset. So, generally, is land that is not genuinely agricultural in use, however it is described in the record. Once it is a capital asset, gains on transfer are computed and taxed in the ordinary way.

Holding period and ratesहोल्डिंग अवधि

For immovable property, the length of holding determines whether the gain is short-term or long-term, and long-term gains are treated more favourably. The specific holding threshold, the applicable rate, and whether indexation is available have all been the subject of legislative change in recent years — which is exactly why this article does not quote a number at you.

Exemptions worth knowing aboutछूट के प्रावधान

Where a gain is taxable, the Act contains relief provisions that a good adviser will consider on your facts. Two are particularly relevant to farmland.

Reinvestment in agricultural land. There is a provision aimed at a person who sells agricultural land used for agriculture and buys other agricultural land — subject to conditions on use, timing and holding. It is not automatic and the conditions matter.

Other general provisions, including reinvestment in residential property or in specified bonds, may be available depending on circumstances. Every one of them has conditions, timelines and paperwork. None of them work retrospectively once you have spent the money.

Tax questions are won and lost on records kept years earlier. From the day you buy, keep the registered sale deed and the stamp duty and registration receipts. Keep proof of payment through banking channels. Keep the mutation order and successive Jamabandi copies showing your name. Keep Girdawari extracts across the years — they are your evidence that agricultural operations actually happened. Keep expenditure records for improvements: bunding, levelling, borewell, fencing. And keep a simple note of dates, because holding period is arithmetic on dates.

Is agricultural land exempt from capital gains tax in India?

Certain agricultural land in India is excluded from the definition of capital asset under the Income-tax Act, so a transfer does not give rise to capital gains at all. Whether a particular parcel qualifies depends on genuine agricultural use and on its distance from a municipality or cantonment, with the distance band linked to that municipality’s population. Have a chartered accountant confirm the position on your facts.

Does the revenue record calling it agricultural land settle the tax question?

Not by itself. The examination looks at whether agricultural operations were actually carried out, alongside the location and population tests. Cropping history and Girdawari entries become useful evidence, which is one reason to keep them.

What relief exists if the gain is taxable?

The Act contains provisions aimed at reinvestment in other agricultural land, specific treatment for compulsory acquisition of agricultural land, and other general reinvestment reliefs. Each has conditions on use, timing and holding. Take professional advice before you spend the proceeds, because most of these cannot be fixed afterwards.

What is the current long-term capital gains rate on land?
